Simon Csoka KC secures stay of case against Joey Barton

Joey Barton, former premiership footballer and manager of Bristol Rovers, was charged with a common assault on his wife. The prosecution sought to rely upon Body Worn Footage and refused to call his wife. Following detailed submissions on res gestae and upon the duty of the prosecution to call evidence, the case was stayed by a District Judge at Wimbledon Magistrates’ Court on 31st October 2022 on the basis that he could not receive a fair trial.
