Dr Felicity Gerry KC’s submissions referred to six times during the new Law Commission of England and Wales Criminal Appeals Consultation Paper issued on 27 February 2025.

Dr Felicity Gerry KC has long raised concerns about the functioning of the Court of Appeal of England and Wales (Criminal Division) particularly in what are known as “joint enterprise” murder appeals. Her submissions were quoted as follows:

11.63 on routine refusals in joint enteprise appeals

12.62 and 12.68 on the need for an interlocultory appeal system as available in Victoria, Australia where Felicity is also admitted

15.80 on the use of visual recording of trials

16.62 on access to a docket of evidence.
