Darren Snow saves nurse’s career in NMC Fitness to Practice case

Darren Snow represented nurse EF before the Nursing & Midwifery Council Fitness to Practice Committee in a case involving multiple dishonesty allegations, lack of integrity and data protection breaches. Darren was instructed by Anahita Sayed of the Roal College of Nursing.  The allegations were such that if found proved strike off was very likely ending this nurse’s career. The NMC sanction bid at the outset of this case was strike off.

Darren’s client had been an exemplary nurse, winning awards for her professionalism, specialising in palliative care. She allowed a medical student to attend the care home where she worked, to learn more about palliative care. The NMC case was that this was allowed without adequate background checks and without management agreement. It was further alleged that the nurse had tried to get the student to lie to her employer and that she had lied in the internal investigation. Following an 8-day hearing all allegations of dishonesty and lack of integrity were dismissed. A condition of practice order was made enabling an immediate return to nursing following over 18 months subject to an interim suspension order. The NMC conceded that there had never been any concerns regarding clinical practice. The Committee took the view there was a public interest in this specialist palliative care nurse ben able to return to nursing.
